Terms of Use

 

The Steve Nash Foundation maintains this and our other websites for the personal use of viewers, to generate support for our programs and initiatives, events, and causes, and to inform the public as to our programs, initiatives, events, and causes. As a non-profit entity, we are greatly appreciative of the generous contributions of photographers, artists, and writers who allow us to use their materials; we ask that you respect the original and subsequent copyrights attached to these.  Nothing contained herein should be understood to waive the rights of these individuals to protect and defend original and subsequent copyright and intellectual property rights attached thereto.

 

Unless provided as noted above or otherwise attributed, material displayed on www.stevenash.org and its pages (including but not limited to stevenash.org/assist and its pages, stevenash.org/dime, stevenash.org/showdown and its pages, and stevenash.org/shield and its pages) (individually and collectively “the SNF Websites”), and on the @stevenashfdn social medial accounts, is the property of the Steve Nash Foundation, and may only be downloaded or otherwise disseminated for non-commercial, personal use, and only in accordance with all copyright and other proprietary notices. The Steve Nash Foundation neither warrants nor represents that any use of materials found on the SNF Websites will not infringe on the rights of third parties affiliated or not affiliated with the Steve Nash Foundation. No information contained on the SNF Websites (including but not limited to all text, word marks, logos, artworks, names, likenesses, images, audio and video) may be distributed, modified, transmitted, reused, reposted, or used in any way for public or commercial purposes, including but not limited to replication for use on products available for commercial sale, to include without limitation physical products, as well as nonfungible tokens, electronic or crypto currencies, without the express written permission of the Steve Nash Foundation.  The Steve Nash Foundation reserves the right to pursue all available legal remedies for unauthorized use of any kind.

 

Accessing, viewing and browsing the SNF Websites is an unlimited and unqualified acceptance of the Terms of Use and all applicable laws, including but not limited to applicable local, state and federal, including both the jurisdiction from which the site is viewed and the jurisdiction of Maricopa County, Arizona.

 

A.  All material (including text and images) displayed on the SNF Websites is either the property of, or used with permission by the Steve Nash Foundation.  Any other use is prohibited, unless such use is prearranged with and approved in writing by the Steve Nash Foundation. Unauthorized use of material may violate copyright, trademark, privacy and publicity laws, and communications regulations and statutes.  The Steve Nash Foundation shall not be liable for any such violation, whether negligent or intentional, and reserves the right to pursue all available legal remedies for any and all misuse, misappropriation, or otherwise unauthorized use of any kind.

 

B.  While we make efforts to verify and update all information on the SNF Websites, the Steve Nash Foundation does not warrant or represent its accuracy or veracity. The Steve Nash Foundation shall not be liable or responsible for any errors or omissions in the content of the SNF Websites.

 

C.  Use of and browsing in the SNF Websites are at your own risk. In no event shall the Steve Nash Foundation or any other party involved in creating, producing, or delivering this site be held liable for any direct, incidental, consequential, indirect, or punitive damages arising from use of the SNF Websites, access thereof, or any other connection to the site (including but not limited to virus transmission). No warranty, express or implied, is made as to the SNF Websites or its contents.

 

D.  The trademarks, logos, and service marks displayed on this site are registered and unregistered trademarks, logos and service marks of the Steve Nash Foundation and others. Nothing contained on the site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademarked or untrademarked logo, name, likeness, image, graphic, word mark, or service mark displayed on the site without the written permission of the Steve Nash Foundation or such third party that may own the trademarks, logo, name, likeness, image, graphic, word mark, or service mark. Any misuse, whether intentional or negligent, is strictly prohibited. In order to maintain the integrity of the Foundation and its initiatives, the Steve Nash Foundation will enforce its intellectual property rights and other applicable rights and remedies to the fullest extent of the law, including, where appropriate, criminal prosecution.

 

E.  The Steve Nash Foundation has not reviewed all of the sites linked to the SNF Websites and is not responsible for the content of any off-site pages or any other sites linked to the SNF Websites. Linking to and browsing of any other site, and maintaining internet safety and security, is at all times the risk of the user.

 

F.  The Steve Nash Foundation may edit, revise, amend or change these Terms of Use at any time, without any advance notice of such change(s) to users. Such terms of use as are posted at the time of viewing or incident shall be the terms of use that bind the user.It is at all times the responsibility of the user to review and understand the Terms of Use in their updated form.

 

G. These Terms of Use and your use of the the Steve Nash Foundation Websites shall be governed by, construed and enforced in accordance with all applicable federal and state laws, and the laws of the State of Arizona, as it is applied to agreements entered into and to be performed entirely within such State.  Any action taken by the user, a third party, or the Steve Nash Foundation, to enforce this agreement or in connection with any matters related to the SNF Websites shall be brought only in either the state or federal courts located in Maricopa County, Arizona, unless otherwise agreed to by the Steve Nash Foundation.  By accessing, viewing and browsing the SNF Websites, the user expressly consents to the jurisdiction of these courts.  If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from this agreement, and shall not affect the validity and enforceability of any remaining provisions.

Privacy Policy

We care about your privacy; this page outlines our use of your information in connection with the SNF Websites.

 

Accessing www.stevenash.org and its pages (including but not limited to stevenash.org/assist and its pages, stevenash.org/dime, stevenash.org/showdown and its pages, and stevenash.org/shield and its pages) (individually and collectively, hereinafter referred to as “the SNF Websites”) signifies your express agreement to the collection and use of information as described herein.

 

A. Information collection and use.  Except as required for delivery of our services, and as provided herein, we will not share your information with any outside or third-party entities.  For a better experience with or to access certain features of the SNF Websites, we may require you to provide us with certain personally identifiable information, including but not limited to your name, phone number, email address, mailing address, billing address, and other relevant information (individually and collectively, hereinafter referred to as “Personal Information”). The Personal Information that we collect will be used to contact or identify you, or to complete the processing of such service or services requested by you through the SNF Websites.  Such services include but are not limited to:

 

B.  Online orders. When making a donation on the SNF Websites, whether or not such donation entails a product provided to you, and/or participating in an auction on the SNF Websites, you are required to provide your Personal Information. By making payment through a credit card, you acknowledge and agree that your billing information will be sent to Cyber Source or another payment gateway provider that processes payment and stores your data connected to the transaction, and agree to the terms of use and privacy policy enacted and enforced by that company.  By making payment with your Pay Pal account, you acknowledge and agree that your billing information will be sent to Pay Pal, and agree to the terms of use and privacy policy enacted and enforced by that company. We retain your order information to be able to fulfill your order and improve our services; the Steve Nash Foundation does not receive or retain access to your full credit card number or Pay Pal account number, and that information is not stored on the SNF Websites.

 

C.  Forms.  When registering for or applying to a program or offering of the Steve Nash Foundation (including but not limited to our email updates), or when submitting a message through the contact form on the SNF Websites, you may be required to submit your Personal Information. Your Personal Information will be stored in the databases of the SNF Websites and in our records related to the programs or offerings for which you registered, and may also be provided by us to a third-party provider of such services, in furtherance of our work.  These may include but are not limited to programmatic providers, corporate collaborators, website developers, and email communication platforms.

 

D.  Cookies.  The SNF Websites use cookies for information and product improvement purposes.  You have the option to either accept or refuse these cookies. If you choose to refuse cookies on the SNF Websites, some functions may be unavailable to you.  Please contact us should you encounter any difficulties, or need assistance.

 

E.  Google Analytics.  We use Google Analytics to provide insight on use, functionality and rates of conversion across the SNF Websites.  Google Analytics uses cookies to collect this data, in accordance with their Terms of Service, which Google may amend at any time, as in this data processing amendment.  The data we collect will be processed anonymously and “data sharing” is disabled; we do not regularly use other Google services in combination with the Google Analytics cookies.

 

F.  Log Data.  When you visit the SNF Websites, your browser sends to us, and the SNF Websites collect information known as “Log Data.” This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser version, pages of the SNF Websites that you visit, the time and date of your visit, the time spent on those pages, and other statistics. Unless required by law or to improve our services, the Steve Nash Foundation does not provide this information to third-party entities.

 

G.  Accessing your account.  You can view your account’s information when logged on the My Account page on the SNF Websites.

 

H.  Service providers.  In addition to the purposes outlined above, we may employ third-party companies and individuals to assist with the facilitation or provision of services; these third parties may have access to some or all of the Personal Information shared by you on the SNF Websites.

 

I.  Security. We value your trust in providing us your Personal Information, and strive to protect it. However, your use of the SNF Websites signifies your acknowledgement that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and the Steve Nash Foundation does not guarantee its security.  Use of and browsing in the SNF Websites are at your own option and at your own risk. In no event shall the Steve Nash Foundation or any other party involved in creating, producing, or delivering the SNF Websites be held liable for any direct, incidental, consequential, indirect, or punitive damages arising from use of the SNF Websites, access thereof, or any other connection to the site (including but not limited to virus transmission). No warranty, express or implied, is made as to the SNF Websites or its contents.

 

J.  Links to other sites. The SNF Websites contain links to many sites that we think may be of interest to users of the SNF Websites. We make every effort to keep the links current, but it is at all times the responsibility of the user to navigate and browse safely.  Other websites may provide links to our site, with or without the express permission of the Steve Nash Foundation; as with the sites to which we link, the Steve Nash Foundation is not responsible for the content of any other website, and is not able to control the information that is contained or collected therein, and assumes to liability related to your experience with those websites.  Linking to and browsing of any other site, and maintaining internet safety and security, is at all times the risk of the user.

 

Children should always check with a parent or guardian before linking to any new sites.  Please refer to the privacy policies on these sites to learn how they collect and use information. 

 

K.  Changes to this privacy policy.  The Steve Nash Foundation reserves the right to update our Privacy Policy from time to time, and may edit, revise, amend or change these terms at any time, without any advance notice of such change(s) to users. Thus, we advise you to review this page periodically for any changes.  Changes posted on the SNF Website constitute the new policies of the Steve Nash Foundation, and are effective immediately upon posting. Such terms of use as are posted at the time of viewing or incident shall be the terms of use that bind the user. It is at all times the responsibility of the user to review and understand the Privacy Policy and its implications in its updated form.

 

L.  Right to opt out. You have the right to “opt-out” of certain of our uses of your personal information. For example, at the time you are requested to provide personal information on the SNF Websites and/or through our offered services, you may have the opportunity to elect to or not to receive promotional correspondence from the Steve Nash Foundation. You may also make this request by sending an email to foundation@stevenash.org. In this e-mail, please identify to which Steve Nash Foundation website or service you are referring (or all of them) and say whether (i) you would like to opt-out of receiving promotional correspondence (including, for example, e-mail offers) in general, or just via a particular method (e-mail, postal mail, etc.). In the event that the Steve Nash Foundation resumes use of promotional SMS messaging, you may opt-out by following the instructions provided by the SMS marketing entity. Note that if you opt-out of receiving promotional e-mails or SMS from the Steve Nash Foundation, we may still contact you in connection with your account or to provide you with important information about the Steve Nash Foundation. A request to have us stop sharing your personal information with third parties will apply as of the first business day following the date of the request, and the Steve Nash Foundation will not be responsible for any communications that you may receive from companies or individuals that received your personal information prior to such request.
