The Steve Nash Foundation maintains this and our other websites for the personal use of viewers, to generate support for our programs and initiatives, events, and causes, and to inform the public as to our programs, initiatives, events, and causes. As a non-profit entity, we are greatly appreciative of the generous contributions of photographers, artists, and writers who allow us to use their material; we ask that you respect the original and subsequent copyrights attached to these.

Material displayed on www.stevenash.org and its pages (including but not limited to stevenash.org/assist and its pages, stevenash.org/dime, stevenash.org/showdown and its pages, and stevenash.org/shield and its pages) (individually and collectively “the SNF Websites”), and on the @stevenashfdn social medial accounts, is the property of the Steve Nash Foundation, and may only be downloaded or otherwise disseminated for non-commercial, personal use, and only in accordance with all copyright and other proprietary notices. The Steve Nash Foundation neither warrants nor represents that any use of materials found on the SNF Websites will not infringe on the rights of third parties affiliated or not affiliated with the Steve Nash Foundation. No information contained on this site (including but not limited to all text, word marks, logos, artworks, names, likenesses, images, audio and video) may be distributed, modified, transmitted, reused, reposted, or used for public or commercial purposes, including but not limited to replication for use on products available for commercial sale, to include nonfungible tokens, electronic or crypto currencies, without the express written permission of the Steve Nash Foundation.  The Steve Nash Foundation reserves the right to pursue all available legal remedies for unauthorized use of any kind.

Accessing, viewing and browsing the SNF Websites is an unlimited and unqualified acceptance of the Terms of Use and all applicable laws, including but not limited to applicable local, state and federal, including both the jurisdiction from which the site is viewed and the jurisdiction of Maricopa County, Arizona.

A.  All material (including text and images) displayed on the SNF Websites is either the property of, or used with permission by the Steve Nash Foundation.  Any other use is prohibited, unless such use is prearranged with and approved in writing by the Steve Nash Foundation. Unauthorized use of material may violate copyright, trademark, privacy and publicity laws, and communications regulations and statutes.  The Steve Nash Foundation shall not be liable for any such violation, whether negligent or intentional, and reserves the right to pursue all available legal remedies for any and all misuse, misappropriation, or otherwise unauthorized use of any kind.

B.  While we make efforts to verify and update all information on the SNF Websites, the Steve Nash Foundation does not warrant or represent its accuracy or veracity. The Steve Nash Foundation shall not be liable or responsible for any errors or omissions in the content of the SNF Websites.

C.  Use of and browsing in the SNF Websites are at your own risk. In no event shall the Steve Nash Foundation or any other party involved in creating, producing, or delivering this site be held liable for any direct, incidental, consequential, indirect, or punitive damages arising from use of the SNF Websites, access thereof, or any other connection to the site (including but not limited to virus transmission). No warranty, express or implied, is made as to the SNF Websites or its contents.

D.  The trademarks, logos, and service marks displayed on this site are registered and unregistered trademarks, logos and service marks of the Steve Nash Foundation and others. Nothing contained on the site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademarked or untrademarked logo, name, likeness, image, graphic, word mark, or service mark displayed on the site without the written permission of the Steve Nash Foundation or such third party that may own the trademarks, logo, name, likeness, image, graphic, word mark, or service mark. Any misuse, whether intentional or negligent, is strictly prohibited. In order to maintain the integrity of the Foundation and its initiatives, the Steve Nash Foundation will enforce its intellectual property rights and other applicable rights and remedies to the fullest extent of the law, including, where appropriate, criminal prosecution.

E.  The Steve Nash Foundation has not reviewed all of the sites linked to the SNF Websites and is not responsible for the content of any off-site pages or any other sites linked to the SNF Websites. Linking to and browsing of any other site is at the risk of the user.

F.  The Steve Nash Foundation may edit, revise, amend or change these Terms of Use at any time, without any notice of such change(s) to users. Such terms of use as are posted at the time of viewing or incident shall be the terms of use that bind the user. It is at all times the responsibility of the user to review and understand the Terms of Use in their updated form.

G.  This agreement shall be governed by, construed and enforced in accordance with the laws of the State of Arizona, as it is applied to agreements entered into and to be performed entirely within such State.  Any action taken by the user, a third party, or the Steve Nash Foundation, to enforce this agreement or in connection with any matters related to the SNF Websites shall be brought only in either the state or federal courts located in Maricopa County, Arizona, unless otherwise agreed to by the Steve Nash Foundation.  By accessing, viewing and browsing the SNF Websites, the user expressly consents to the jurisdiction of these courts.  If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from this agreement, and shall not affect the validity and enforceability of any remaining provisions.
